European hosting, sovereign AI: why are they not the same thing?

“Your data is hosted in Europe”: the argument is reassuring, but it leaves out the essential. Hosting data in Europe with a provider subject to foreign law does not change its jurisdiction: the location of the server does not protect you from the operator’s law. The sovereignty of an AI system is judged on four cumulative dimensions: the jurisdiction of the operator and its subcontractors, where processing actually takes place, control of the model (dedicated or shared), and reversibility.

The point most often left out: processing, not just storage

A service may advertise data centres in Europe and still be operated by an entity subject to foreign law: that country’s authorities retain legal leverage over the operator, and therefore over your data. Conversely, European hosting with a European operator is not enough either if inference — the AI processing itself — is subcontracted to an extraterritorial model interface: your documents make the round trip outside your legal perimeter at every query.

The five-question assessment grid

Who operates the service, and under which law? Where does inference run, and who runs it? Is the model pooled across clients or dedicated? Do my data or its derivatives (indexes, logs) leave my perimeter, even in transit? What happens at the end of the contract, and how is deletion proved? A genuinely sovereign provider answers in five sentences; the others answer with a brochure.
